Guiding verdict of the Basel-Stadt Criminal Court against a Holocaust denier

In a proceeding against an exponent of the Basel PNOS section, the Basel
Criminal Court sets an example against the denial of the Holocaust.

The ANNE FRANK FONDS and Buddy Elias appreciate the point of view of the
Basel Criminal Court. Whoever denies the Holocaust and denominates the
diaries of Anne Frank as a tangle of lies and as a historical lie, respectively,
commits an act of racial discrimination.

Since June 11, 2009, the Basel PNOS section has made noticeable on its homepage an
article entitled «The lies around Anne Frank». With this text, racially discriminating in the
sense of Art. 261bis al. 2 and 4 of the Swiss Penal Code, the PNOS disputes and denies,
respectively, the history of the Holocaust and depicts Anne Frank as a victim of the Allied
rather than of the National Socialists. Moreover, the PNOS implies that the Jewish girl
Anne Frank have with her Diaries of Anne Frank created a tangle of lies; Anne Frank and
thus the Jews hereby are degraded to be liars. The ANNE FRANK FONDS, domiciled in
Basel, as well as Anne Frank’s cousin Buddy Elias referred this case for investigation
according to Art. 261bis Swiss Penal Code (racial discrimination) to the Public Prosecution
Office with their petition dated June 22, 2009.

On July 21, 2010 the Criminal Court of Basel-Stadt sentenced the responsible for the
PNOS Basel section’s homepage, who at the same time is the author of the text entitled
«The lies around Anne Frank», to an unconditional penalty of 90 daily rates of income at
CHF 120 for breach of Art. 261bis al. 2 and 4 of the Swiss Penal Code. The ANNE FRANK
FONDS and Anne Frank’s cousin Buddy Elias expressed their satisfaction with the Criminal Court of Basel-Stadt’s sentencing the responsible for racial discrimination. It cannot be tolerated that the Holocaust is denied and the Diaries of Anne Frank are depicted as a tangle of lies and a historical lie, respectively. The Criminal Court of Basel-Stadt announced to the sentenced person with unambiguous words that also after this sentence the Justice will furthermore intervene ex officio in case he continues to propagate the text entitled «The lies around Anne Frank», be it on the PNOS homepage or otherwise.
